TERMS OF USE
1. The following registration and terms and conditions of use apply to the relationship
between the user on the one hand and PRO+ AUCTIONS BV, with registered office at 3650 Dilsen-Stokkem, Rijksweg 203 and company number 0800.537.238 on the other hand, when using and registering on the website.
We request users to thoroughly read through these registration and terms of use
before using the website. PRO+ AUCTIONS may amend these registration and
terms of use at any time. Any use of the user account by
for example logging in to the website following the publication of the amended
registration and terms of use constitutes an acceptance of these new registration and
terms of use. The latest version of these conditions is always listed at the top.
2. Further use of the website by the user, such as participation in
online auctions, conclusion of the purchase agreement, payment and collection of the
lots/goods, shall be subject to the general terms and conditions and, if stated, the applicable special terms and conditions of PRO+ AUCTIONS BV or its (sales) partners, if any.
3. Users cannot derive any rights whatsoever from the website or its content
. No information or content on the website may be used, copied or
published for non-private or commercial purposes, except with the
express prior consent of PRO+ AUCTIONS BV or the relevant holders of
intellectual property rights.
4. If one or more of the provisions or part of a provision of these Terms of Registration and Use should be declared null and void, such nullity shall not affect the validity
of the other provisions. The parties shall immediately and in good faith
negotiate a valid provision to replace the void provision, which corresponds as much
as possible to the purpose of the void provision.
REGISTRATION CONDITIONS
1. The user explicitly accepts the present registration and terms of use upon
registration of his/her user account on the Website.
2. To create a user account, the user must provide certain (personal) data,
such as his/her name, email address, address, language, mobile phone number; and capacity (natural person/company). Afterwards, the user chooses his/her own password
for his/her personal user account.
3. The user guarantees the accuracy and completeness of the specified
(personal) data and undertakes to keep the data up to date and to update
should they change. The user also undertakes to keep his password
secret and not to transfer his user account.
4. PRO+ AUCTIONS BV reserves the right to refuse or terminate the registration of a user account at any time and without stating reasons.
5. The user accepts that PRO+ AUCTIONS BV will use the (personal) data, inter alia, for the management and optimisation of the website, as read and approved by the user in the privacy policy.
6 Upon registration of his/her data and creation of an account, the user agrees to be bound by the general terms and conditions and any special conditions, which can also be found on the homepage of the website and at the lot, and which can easily be consulted. If the user does not agree to these terms and conditions, the user cannot create an account.
LIABILITY
1. PRO+ AUCTIONS is solely responsible for the management of the website. All other
services provided via or in addition to the website, such as the organisation and execution
of online auctions, the private sale, the (dis)payment and the collection of the
goods, are entirely the responsibility of the seller or the PRO+ AUCTIONS
Partner, as provided for in the general terms and conditions and any applicable
special conditions.
2. All information on the website is for informational purposes only. The website and its
content are intended to provide an overview of the services of PRO+ AUCTIONS, Partner(s) and the lotteries/goods on offer.
Although PRO+ AUCTIONS endeavours to keep the information on the website up to date and accurate, certain information may be incomplete or inaccurate. Buyers or bidders are always deemed to have carefully inspected the lots and/or goods at the viewing times provided for that purpose and thus to be aware of and accept the characteristics, including visible and/or communicated defects, before placing a bid. The information on the website regarding the goods/ lots offered and the descriptions of the auctions/sales is provided and managed by the seller and/or the PRO+ AUCTIONS Partner.
PRO+ AUCTIONS cannot be held liable for any damage that occurs or may occur as a result of incomplete or inaccurate information on the website.
3. PRO+ AUCTIONS is not liable for the bidding on or the sale of lots/goods during an online auction or private sale in which the user participates.
All online auctions and private sales are the sole responsibility of the seller or the PRO+ AUCTIONS Partner, as provided for in accordance with the general terms and conditions and any applicable special conditions.
PRO+ AUCTIONS is only responsible for the management of the website and is never involved in the event of a dispute regarding any aspect of the online auction.
4. PRO+ AUCTIONS is not liable for any technical problems in connection with
visiting or registering on the website.
5. PRO+ AUCTIONS will not be liable if bids cannot be made or the auction and/or private sale is prevented due to technical imperfections. In such a case, the user cannot claim compensation for any direct or indirect damage, including loss of an opportunity.
RIGHTS AND OBLIGATIONS
The seller shall always bear responsibility for the legality of his actions and the products or lots for which the seller has instructed PRO+ AUCTIONS or partner to offer and/or auction. Accordingly, the Vendor guarantees that its goods or lots comply with the
applicable legislation, that it is the lawful holder of the intellectual property rights
resting on them and that these products or lots do not infringe the rights of
third parties.
Users shall, in the above cases, address exclusively the
relevant vendor and shall not hold PRO+ AUCTIONS or its Partner(s) in any way
liable or involved in any proceedings.
They shall timely inform PRO+ AUCTIONS of the existence of a potential infringement or illegality on the website in order to give it the opportunity to investigate it and take the necessary measures or not, such as the removal of infringing content or the cessation of an auction of infringing goods.
COMPETENT COURT AND APPLICABLE LAW
1. The Registration and Terms of Use and the legal relations arising therefrom are governed by
Belgian law.
